General Terms

These sales conditions are concluded on one hand by Rhein 1905 SA, with VAT number IDE: CHE-499.589.727, and whose registered office is located at rue du Mont-Blanc 3, 1201 Geneva, hereinafter referred to as "the seller" and on the other hand, by any natural or legal person wishing to make a purchase in-store or via the "Seller"'s website, hereinafter referred to as "the buyer".

Subject

These sales conditions aim to define the contractual relationships between the Seller and the buyer and the conditions applicable to any purchase made through the Seller's online store, whether the buyer is a professional or a consumer.

The acquisition of a good or service through this site implies the buyer's unconditional acceptance of these sales conditions.

These sales conditions will prevail over any other general or specific conditions not expressly agreed upon by the Seller.

The Seller reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer and accepted by them if they differ from those displayed in-store or on the "seller"'s website.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Seller's website.

These products and services are offered within the limits of available stock.

Each product is accompanied by a description provided by the supplier.

The photographs in the catalog are as faithful as possible but cannot guarantee a perfect similarity with the offered product, particularly regarding colors.

Prices

The prices listed in the catalog are inclusive of VAT in CHF, taking into account the applicable VAT rate on the day of the order; any change in the rate may be reflected in the price of the products or services.

The Seller reserves the right to change its prices at any time, it being understood that the price listed in the catalog on the day of the order will apply, except for tobacco products that have undergone a price change between the order and preparation, an adjustment will be made based on the label price, equal to the tariff value, equal to the payment.

The indicated prices do not include order processing, transportation, and delivery fees as long as they occur in the geographical areas specified below.

Geographical area

The online sale of the products and services presented on the site is accessible worldwide.

EXCEPTION: Tobacco products: We do not accept orders intended for the United States of America (USA) and all territories belonging to it.

THE SALE OF TOBACCO AND ALCOHOL IS STRICTLY RESERVED FOR PERSONS OVER 18 YEARS OLD, ALL PERSONS CHECKING THE BOX OF THE CONDITIONS DECLARE TO HAVE THE REQUIRED AGE AND MAKE PURCHASES FOR EXCLUSIVELY PERSONAL USE.

All our tobacco products are fully taxed and excised.

All our alcohol products are fully taxed and excised.

"The Seller" disclaims any responsibility in case of seizure or fine.

All sales are made from the store.

Orders

The buyer, who wishes to purchase a product or service, must necessarily:

  • fill out the identification form on which they will provide all the requested contact information or give their customer identification if they have one;
  • fill out the online order form by providing all the references of the chosen products or services;
  • validate their order after verifying it;
  • make the payment under the specified conditions;
  • confirm their order and payment.

The confirmation of the order implies acceptance of these sales conditions, acknowledgment of having perfect knowledge of them, and waiver of relying on their own purchasing conditions or other conditions.

All provided data and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute a signature and acceptance of the transactions carried out.

The seller will communicate the confirmation of the recorded order by email.

Withdrawal

Buyers, non-professional individuals, benefit from a withdrawal period of seven days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs and provided that the products and packaging are in perfect condition.

Payment terms

The price is due upon ordering.

Payments will be made online by credit card or offline by bank transfer and in-store by credit card or cash.

Online payments will be made through the secure NETS system so that the transmitted information is encrypted by software and no third party can access it during transport over the network.

At the buyer's request, a paper invoice showing the VAT will be sent to them.

Ownership rights

Until full payment for the products or services ordered on our account is made, the Seller remains the owner of the goods.

Deliveries

Deliveries are made to the delivery address indicated in the order confirmation upon full payment for the products or services.

The risks are borne by the buyer from the moment the products leave the Seller's premises. In case of damage during transport, a justified complaint must be made to the carrier within three days of delivery.

Delivery times are given for informational purposes only:

If the products are in stock, orders are shipped within 3 working days (Switzerland)

If the products are not in stock, the customer will be notified of the necessary timeframe, which is for informational purposes as the merchant depends on the timing of their suppliers. The customer may request to cancel their order and will be refunded.

Exception: products specially ordered by the buyer, and the buyer having been informed.

Warranty

All products supplied by the Seller are covered by the warranty provided by the manufacturer.

In case of non-compliance of a sold product, it can be returned to the Seller who will take it back, exchange it, or refund it.

All claims, requests for exchange or refund must be made within thirty days of delivery to the address info@rheincigars.ch

Liability

The Seller, in the online sales process, is only bound by an obligation of means; their liability cannot be engaged for any damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary issues.

Intellectual Property

All elements of the Seller's site are and remain the intellectual and exclusive property of the Seller.

No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether they are software, visual, or sound.

Any simple or hypertext link is strictly prohibited without the express written consent of the Seller.

Personal Data

Personal information related to buyers may be subject to automated processing.

The Seller reserves the right to collect information about buyers, including through the use of cookies. The collected information will not be transmitted to third parties.

Users have the right to access and rectify data concerning them.

Dispute Resolution

These online sales conditions are subject to Swiss law.

In the event of a dispute, jurisdiction is granted to the competent courts of Geneva.
